Terms of Service

The following is Cartel Starborne's (Victor Ashcraft Stokes') Terms of Service for personal, non-commercial work.

 

Commercial works are subject to different terms and conditions, and any commercial inquiries must be sent to

Please do not e-mail me repeat e-mails more frequently than once a week.  If you do, I will likely mark you as spam.

 

You are bound by these Terms of Service even if you don’t read them.  By agreeing to purchase my art and/or services or otherwise work with me professionally, you automatically agree to my terms and conditions. I have the right to change the following information with or without warning, though I will at minimum maintain the “last updated” date at the top (this date may vary across different pages/sections of my ToS).  If you have received art from me by any means before updates made in my ToS, the updates still apply to you unless otherwise agreed upon (with written evidence) and/or in relation to your payment, my quality of work/craftsmanship, or warranty information.

 

In my Terms of Service (ToS) I am speaking to “you” (and other variations) as if the reader is the client in question and “me” (and other variations) as Victor A.S. also known as Cartel the Creature, CartelSaide, or simply Cartel.

 

In my ToS, I refer to and mostly mention/discuss [paid] commissions, but this ToS applies regardless of how you recieved your piece (trade, virtual currency, etsy, raffle prize, convention, etc.).  Just replace the word “commission” and/or other similar phrasings to apply directly to the situation as is relevant if necessary.

  • I have the right to deny your business for any reason.  If I have began work on your commission and then end business with you abruptly, you will have a choice: you can either get a partial refund equivalent to the amount of work I haven't yet completed and retain personal rights to the incomplete piece, or you can get a full refund and I will retain full rights to the piece.

    • If I end business with you abruptly due to harassment or major conflict, I will not provide a refund and I will retain full rights to the commission.

  • You get what you pay for.  So please, have a look at my gallery and provided links to my off-site galleries so that you have a good idea of my quality/skill and style before commissioning me.​

  • My work is intended for personal use only, not for profit nor mass production.  You may repost the piece to your personal online galleries, you can crop the pieces for use in things like profile icons, signatures, etc., and you can use the art to create personalized items, such as a poster for your room.  However, you may not...

    • ...get my work tattooed on your body unless you own the personal rights to the piece.​

    • ...duplicate/copy my work unless it is for private, personal use.

    • ...financially gain from duplicated/copied/stolen work.

  • When publicly displaying my artwork, online or in person, you are required to make it expressly clear that I am the creator.  You can do this by providing a caption with my name as well as linking to my website, any of my social media accounts, and/or any of my off-site galleries.​  You can find links to all of these on my main website (this website).​​

  • Please have patience with me! Commissions do not have an expected end date (unless otherwise stated upon purchase). Depending on the type of commission, the size of the piece, how long you take to respond to inquiries and progress updates, and my personal queue, it is impossible for me to give you an accurate time-frame to expect all commissions to fall under.  However, I will always do my best to complete them within a timely manner, I will be sure to update you about the progress of your commission, and you are always free to give me a friendly reminder if you feel that I am taking too long or just want another update.  If you want a piece done by a certain time, depending on the time limit, there may be an added rush fee.​

  • I do not do private commissions.  In the case of gifts with a time limit (example: birthday gifts) I am willing to hold off on publicly posting a piece until the requested time.  If that time frame exceeds a full year, however, a case-by-case fee may be required.

  • Requests/"Freebies" ≠ Commissions!  See my FAQ for further clarification.

    • I am not responsible for any dissatisfaction with requested pieces.

    • If I inquire about specifications/detail work on a requested piece, note that I’m looking for direction, not dictatorship. Your advice therefore may or may not be taken into consideration.  If you want something particular/specific, then you will just have to commission/trade with me.

    • Unless I explicitly specify that I am offering you a free commission, then you are not getting a free commission, you are getting a gift and/or request/”freebie” piece.  I will specifically state the words “free commission” if that’s what I intend by it.  Any other wording in regards to free art is simply to be considered a request/"freebie" and/or gift art.

  • I am not responsible for any damage, injury, and/or death to property and/or any living creatures by (mis)use/(mis)handling of my product(s).  Please use common sense, follow any safety rules potentially included with your commission(s), and don’t dangerously misuse products.  Keep products that are made with/of small pieces away from babies, young children, and animals, as they are a choking hazard.

The following terms and conditions are specific to my traditional work.  Traditional work ToS includes all other relevant Terms and Conditions as well.

 

  • Your commission is for personal use only and is otherwise copyright to me. You may own the character and the piece, but I retain the copyright to the image.

    • Cropping my art does not change any rights to the piece.  My art with the signature cropped out for example, is still my art.

  • HOW COMMISSIONS WORK:

    • I will send you a progress picture during the basic sketch stage of your commission as I’m working on posing and other basic details.  During this stage is the only time that you can request changes on the piece if anything is incorrect and/or unsatisfactory.

      • ​You may ask for a complete redo of the basic sketch stage once if the basic concept is unsatisfactory.  After that, you are required to pay an extra fee for continued, redone sketches.  This fee = 50% of the base cost of a basic sketch of your character.
      • I am not responsible for any flaws in the basic design of a piece that you do not bring to my attention at this stage.
    • Once we've confirmed the basic sketch, I will continue working on your piece.  I am not responsible for any dissatisfaction stemming from â€‹the basic concept of the piece from this point forward.
    • When a piece is completed, it is very unlikely that a piece can be altered in any way.  So please bring any and all issues to my attention as soon as possible as you receive work in progress pictures!
  • For rush/time-constrained commissions, I will not do pieces under a time limit of 1 week or sooner.  This time limit would start upon my agreement to take your commission, and does not include the time it will take for your commission to get to you via mail or other means.

    • For larger commissions (such as pieces with canvases as big as or larger than myself), this time limit extends to 2 weeks - 1 month or sooner.

The following terms and conditions are specific to my crafted work.  Crafted work ToS includes all other relevant Terms and Conditions as well.

 

  • Do not [commercially] use my pieces as examples of the quality of your supplies/products without my explicit written permission.

  • Do not buy my products with the intent to resell and turnover a profit.  If you want to make a bulk, commercial purchase, e-mail me first.

  • You are allowed to resell a product if you purchased it, and no longer want it, however.​  When possible, please contact me before reselling, as I may be interested in buying back or adding additional things (warranty, coupon code, discounted additional work, etc.) to your listing that may increase your chances of selling.

  • Do not claim altered works as your own creations unless they are altered beyond recognition.  Please credit me where credit is due, however.

  • You may not commercially feature my work as a product in your shops, on or offline, without my explicit written permission.

  • For rush/time-constrained commissions, I will not do pieces under a time limit of 2 weeks or sooner.  This time limit would start upon my agreement to take your commission, and does not include the time it will take for your commission to get to you via mail or other means.

    • For certain larger commissions (such as furniture or similarly sized creations), this time limit extends to 1-2 months or sooner.
